COOPER, JUSTICE This is an action by appellant to recover worker's compensation benefits for an injury received when a tractor-trailer operated by appellant over-turned. The basic issue is whether appellant, the owner-operator of a tractor under contract with appellee, was an independent contractor or an employee of the appellee. The trial Judge held that appellant was an independent contractor and dismissed the action. For the reasons set forth below, we affirm the decision of the trial Judge.
